Eric Holder Contempt Resolution Passes, But Legal Dispute Looms

WASHINGTON -- The Justice Department has declared that Attorney General Eric Holder's decision to withhold information about a bungled gun-tracking operation from Congress does not constitute a crime and he won't be prosecuted for contempt of Congress.

In a letter to House Speaker John Boehner, the department says that it will not bring the congressional contempt citation against Holder to a federal grand jury and that it will take no other action to prosecute the attorney general.

Deputy Attorney General James Cole says the decision is in line with long-standing Justice Department practice across administrations of both political parties.

House Republicans won a historic political fight to hold Attorney General Eric Holder in contempt of Congress, but the GOP probably is still a long way from obtaining documents it wants in an investigation of a bungled Justice Department gun-tracking operation.

There are two routes to enforcing the contempt citations approved by the House on Thursday, a criminal prosecution and a civil lawsuit, although the White House on Friday virtually shut down the criminal path. The civil route through the courts would not be resolved anytime soon.

White House spokesman Jay Carney said Justice Department going back to the administration of President Ronald Reagan has not pursued prosecutions in contempt cases involving assertions of executive privilege.

President Barack Obama invoked a broad form of the privilege to prevent sending department documents to the House Oversight and Government Reform Committee. The chairman, Rep. Darrell Issa, R-Calif., is leading the effort to get the material related to Operation Fast and Furious.

"This is pure politics," Carney said.

"Remarkably the chairman of the committee involved here has asserted that he has no evidence that the attorney general knew of Operation Fast and Furious or did anything but take the right action when he learned of it.

"No evidence, so if you have no evidence as he has stated now about the White House and the attorney general, what else could this be but politics?"

More than 100 Democrats walked out of the House chamber to boycott the first of two contempt votes, saying Republicans were more interested in shameful election-year politics than documents.

Republicans demanded the documents for an ongoing investigation, but their arguments focused more on the need for closure for the family of slain Border Patrol agent Brian Terry. Two guns from the gun-tracking operation were found near his body after a shootout in Arizona.

Democrats promised closure as well, but said a less-partisan Republican investigation was the only way to get it.

Adding to the emotion of the day, the family of the slain agent issued a statement backing the Republicans.

"The Terry family takes no pleasure in the contempt vote against Attorney General Eric Holder. Such a vote should not have been necessary. The Justice Department should have released the documents related to Fast and Furious months ago," the statement said.

It all happened on the day that President Barack Obama's health care law survived in the Supreme Court, prompting some Democrats to speculate that the votes were scheduled to be overwhelmed by news stories about the ruling.

About five hours after the court ruled, with news sites flooded with information about the health care ruling, the House voted 255-67 to declare Holder in criminal contempt.

The matter goes to the U.S. attorney for the District of Columbia, who works under Holder.

A second vote of 258-95 held Holder in civil contempt and authorized the House to file a lawsuit.

In past cases, courts have been reluctant to settle disputes between the executive and legislative branches of government.

The issue became more complicated when Obama invoked a broad form of executive privilege, a legal position that is designed to keep private certain communications of executive branch agencies.

Issa's committee will consult with the House counsel's office about a court challenge to the administration's decision not to cooperate, spokesman Frederick Hill said.

The documents were written after Fast and Furious was shut down. The subpoena covered a 10-month period from February 2011, when the Justice Department denied that guns purchased in the U.S. were allowed to "walk" across the border into Mexico, to early December 2011 when the department acknowledged the earlier assertion was in error.

Republicans said the contempt citations were necessary because Holder refused to hand over documents that could explain why the Obama administration took 10 months to come clean about gun-walking. The operation identified more than 2,000 illicitly purchased weapons. Some 1,400 of them have yet to be recovered in the failed strategy to track the weapons to gun-running rings.

"Gerrard," the barista said, pushing an oversized iced coffee toward the corner of the counter.

"Gerrard?" she asked again. "Gerrard? Or Gerald? Is it Gerald?" It sat unclaimed as cappuccinos and half-caffs came and went. "Hey, you," she said, nodding when I finally looked up. "Your coffee is thawing."

It was the name on my shirt. Gerrard. My No. 4 England home jersey, still wrinkled from being balled up and thrown across the coffee table on Sunday afternoon and still unfamiliar, despite the ongoing Euro 2012.

"Don't you know who Steven Gerrard is?" I wanted to ask, ranting about his passing, his delivery and his accuracy. "And why aren't you watching Spain-Portugal," I'd say, shoving my live-streaming iPad toward the flavored syrups. Instead, I mumbled a 'thank you' before promptly tie-dying all three embroidered Lions with a stream of spilled coffee.

I've spent the past two weeks immersed in Euro 2012, rearranging my afternoons around the group stages, reading oversized tabloid headlines and wondering when Mario Balotelli will do something that results in a homemade t-shirt and/or a detour to a women's' prison.

As a Liverpool supporter, England has always been 'my' national team, even though I have zero in common with the Three Lions other than a shared respect for Gerrard, a habit of being consistently disappointing and a willingness to fight someone over a Phil Collins song.

So Sunday's quarterfinal loss to Italy is just another penalty kick-in-the-teeth that will be etched into my ? our ? collective memories, a banner hoisted into the rafters beside 1990, 1996, 1998, 2004 and 2006, the retired numbers of shame. England spent 120 minutes on their heels, making the kind of hesitant, halting passes I haven't seen since prom night.

Despite controlling the pace of the game and the ball possession ? a lopsided 68 percent ? Italy didn't capitalize until Andrea Pirlo's gloriously cocky Panenka penalty kick gently shattered England's psyche, a move so perfectly douchey, he should've just popped his collar and broken up with Molly Ringwald on the way to midfield. It also served its purpose, making Ashley Cole look like Ashley Young and Ashley Young look like Ashley Olson.

That kick, and the two that followed, ended England's Euro vacation and they don't have anything on their national team calendar until, um, John Terry's racism trial. I should be doubled over in disappointment. And I was. I am. But it doesn't feel like my pain.

As much as I align myself with the team, and as many post-loss managerial excuses and sackings I've suffered through, I feel disconnected by both heritage and history. Even the songs feel wrong. I can't yell "I know I am, I'm sure I am" without feeling like I'm mouthing the words to a hymn I don't believe in.

Maybe Italy will be different.

I don't advocate changing colors, especially to the team that just Pirlo'ed all over your upholstery. It feels as uncomfortable as wedging your incisors into someone else's retainer: wrong, unfamiliar, awkward. But after more than a year of paperwork and Google Translate-ing, of apostilles and certified long form birth certificates, I'm three months from becoming an Italian citizen.

I qualify for dual citizenship jure sanguinis ? right of blood ? through my father's family. So after phone calls to long-forgotten halls of records and middle-of-the-night faxes (Thank you, 1990!) I'll check into the Italian Consulate and will walk out with a shiny second passport, like Jason Bourne if he were less lethal and more likely to trip over something in the lobby.

Will Italy feel more like 'my' team after I have a laminated picture and a validated parking ticket? I don't know, although my dad's hair alone should've given him a spot on the reserves.? Football wasn't in the front of my brain when I started this process; it was a way to connect with family I've never known and never will, from my Renaissance painter relative to my great-grandfather to those distant cousins wedged intermittently between the Dolomites.

I don't know if my grandfather, an American citizen, was a soccer fan. The dates on my birth certificate and his death certificate are unsettlingly close together, so we never had the chance to talk about it. My memories of him are limited to his mustache, his dog and one Thanksgiving that has been faded by my mind's own Instagram filter. He shared his name with my dad. And he'll share his heritage with me.

Today I'll slowly try out my new almost-allegiance, as Juventus teammates (and 2006 World Cup winners) Pirlo and Captain Keeper Gigi Buffon try to play the umlauts off of Mesut ?zil and the rest of Joachim L?w's Germans.

Although their last meeting was a 1-1 draw, Gli Azzuri are I Perdenti ? the underdogs. Germany has had an extra 48 hours to rest, recover and prepare. They know what Pirlo, what Mario Balotelli, and what Antonio Cassano are capable of (as opposed to Roy Hodgson, who seriously expected Chia Head Rooney to keep pressure on Pirlo).

I'll be watching, attempting a few tentative cheers for each cross, for each attack, just to see how it feels.

I know that Italy could get by without me.? I'm just not sure it works the other way around.

On this point Alon said, ?As shown in the July 2010 Kaufman Foundation report, startups are the job creation engine in the American economy. Without startups there is no net job growth. Access to capital for small business is a challenge; small businesses have relied on financing from community members, as well as credit card debt, loans, and angel investors. Debt structures often come at a high cost and burden to entrepreneurs, who may lack regular cash flow, during the growth stages of their companies.?

3. Crowdfunding empowers investors.

The JOBS Act enables small investors to provide support to?capital seeking entrepreneurs,? Alon said. ?Crowdfunding portals and regulators are able to drive standardized?and understandable terms across offerings. This allows crowdfunding investors to become?educated and aware of the offering terms and risks. Investors in crowdfunding offerings are able?to clearly see the terms and success of an offering, and are able to directly communicate with the?issuer and other investors.?

Overview

-- We believe B&N Bank's historically high concentration risks in Russia's weak construction and commercial real estate sectors will continue to decline. This has led us to change our assessment of the bank's risk position to moderate from weak.

-- In our view, B&N Bank also has a moderate business position, weak capital and earnings, average funding, and adequate liquidity. We assess B&N Bank as having sufficient liquidity for the next 6-12 months.

-- We are therefore raising our long- and short-term credit ratings on Russia-based B&N Bank to 'B/B' from 'B-/C' and the Russia national scale rating to 'ruA-' from 'ruBBB+'.

-- The stable outlook reflects our anticipation of a continuous improvement of the bank's risk position within the next 12-18 months as lending concentrations reduce and if the bank successfully implements its new strategy.

Rating Action

On June 28, 2012, Standard & Poor's Ratings Services raised its long-term counterparty credit rating on Russia-based B&N Bank to 'B' from 'B-' and the short-term counterparty credit rating to 'B' from 'C'. The outlook is stable.

At the same time, we raised the Russia national scale rating to 'ruA-' from 'ruBBB+'.

Rationale

The rating actions reflect the revision of our assessment of B&N Bank's risk position to 'moderate' from 'weak', as defined in our criteria. We base this on our anticipation of a substantial reduction of the bank's single-name and industry concentrations over the next two years. Concentration in commercial real estate and construction loans fell to 34% in 2011 from approximately 45% in 2010. We believe it will decline further by the end of 2012 and continue to do so if the bank successfully implements its new business strategy. This strategy aims to increase lending to small and midsize enterprises and individuals and eliminate the largest exposures.

As of Dec. 31, 2011, the top 20 borrowers represented more than 400% of B&N Bank's adjusted total equity (ATE) and 50% of its loans. By our calculations, these concentrations should decrease to about 260% of expected ATE in 2012, taking into account a planned equity increase of $100 million before the end of the year.

We assess B&N Bank's funding as 'average' and its liquidity as 'adequate', which underpins the raising of the short-term rating to 'B' from 'C'. We believe the bank to have sufficient liquidity for the next 6-12 months. This is based on our view of an adequate liquidity cushion that exceeded 20% of the bank's assets as of March 30, 2012, comprising cash, interbank placements, and liquid securities available for sale-and-repurchase transactions.

The bank's stand-alone credit profile (SACP) is at 'b', and our assessment of other components of the SACP is unchanged. Our ratings on B&N Bank reflect the 'bb' anchor we use for commercial banks operating in Russia and the bank's 'moderate' business position, 'weak' capital and earnings, 'moderate' risk position, 'average' funding, and 'adequate' liquidity.

We regard the bank's business position as 'moderate' due to its limited market shares. B&N Bank is a midsize commercial bank active in 34 regions of Russia, and it has a nationwide market share of less than 1% in loans and deposits. We assess capital and earnings as 'weak,' reflecting our projected risk-adjusted capital (RAC) ratio for the bank, before diversification, of 3.9%-4.3% over the next 18-24 months. The long-term counterparty credit rating reflects B&N Bank's SACP and does not include any uplift for extraordinary external support, either from the bank's shareholders or the government.

Outlook

The stable outlook reflects our assessment that the bank will likely maintain a positive financial performance, improve its margins, and generate adequate revenues to maintain its capitalization. Continuous reduction of concentrations in the loan book is crucial to our risk assessment and maintenance of the ratings.

We could take a positive rating action if the bank posted more conservative growth rates over time, without a significant deterioration of asset quality.

We could lower our risk assessment to 'weak' from 'moderate' and subsequently take a negative rating action if, contrary to our expectation, the bank were unable to reduce concentrations or experienced a setback in executing its new strategy. Deterioration of asset quality beyond what we anticipate, a sharp decline in liquidity reserves, or deposit outflows could also result in a negative rating action. If the RAC ratio were to deteriorate to less than 3%, this could also prompt a downgrade.

Although smartphones based on Android have typically sold more overall units than iOS-based smartphones, Apple?s iPhone has long been the top individual smartphone sub-brand, easily besting the assorted Droids, Galaxies and One-series devices?that have stood in its path. But according to Strategy Analytics, Samsung?s Galaxy series has now overtaken the iPhone as the number-one individual smartphone sub-brand in the world. ?Samsung and Apple are currently the clear leaders, and with their deep pockets enabling hard-to-match marketing spend, they represent a considerable challenge to the chasing pack,? the firm wrote in the abstract on its latest study. The company also found that the nine largest smartphone families such as the iPhone, the Galaxy series and the Motorola Droid series, accounted for more than two-thirds of all smartphone shipments in the first quarter of 2012.

Science of Relationships - | - I Kissed a Boy?and my Boyfriend Didn ...

My boyfriend and I of a very long time broke up two days ago, and I'm at a total loss of where to go from here. We had an amazing relationship with very little problems or issues, and I honestly thought that this could be my future husband. But about a month ago we were going through a rough patch and I made what is unquestionably the biggest mistake of my life and kissed another man. This man has no emotional meaning to me and it was a one-time occurrence.

I debated for weeks if I should tell him but I decided not to knowing he would break up with me and knowing it would never happen again. The man I kissed though had other plans and told others after I told him how important it was to keep between us because it had been a mistake. My boyfriend of course found out and asked me if had anything to tell him, and I confessed right then knowing he had found out. I told him how sorry I was and that there was absolutely no excuse for what I?d done. I told him the whole situation and that I only love him. I told him I wanted to work through it and earn his trust and forgiveness back but he broke up with me stating "I want to be with you but I have to break up with you".

So we haven't spoken in two days and here is my question for you. Do I let him go because I love him, or do I fight for him because I love him? I am 100% committed to fixing it and want him back but should I just set him free? He says he still loves me but should respect himself enough to break up with me. I have no idea what to do, but I know he's the one and I'm so lost. Please help!!

Thank you for your question and I am sorry to hear how difficult this has been for you. Letting a relationship go when you are still very much attached to a partner can be very painful. While some may interpret you kissing another guy as cheating (which it seems your ex did), others may not see it that way. In a recent paper that explored perceptions of what constitutes cheating behaviors,¹ three different types of cheating were identified: explicit, deceptive, and ambiguous. Explicit behaviors were those that most people label as infidelity, such as sex. Deceptive behaviors were those that were intended to be hidden from a partner, such as lying. Finally, ambiguous behaviors were those that made it difficult to tell what is going on, such as hugging or dancing with someone else. Interestingly, kissing someone was not an easy behavior to classify in the studies that were reported: sometimes participants rated kissing as explicit cheating, while other times they did not. How might your ex-boyfriend have interpreted your kissing behavior? He could have been upset because he interpreted your kissing as explicit cheating. He may have interpreted the behavior as deceptive as well, as he heard about the incident from someone else weeks later.

In terms of how your ex-partner responded to your kissing someone else, men and women both experience anger when confronted with sexual infidelity, but both men and women are more upset and distressed when thinking about an emotionally unfaithful partner.² Although you describe your kiss as having no emotional investment, your ex might have interpreted it differently and consequently experienced anger or distress.

Now for some tough love?.From what you describe, it sounds as if your relationship was undergoing some challenges even before you kissed this other man. The breaking-up process actually takes some time; it typically starts with an awareness that things are not right in the relationship (in your case, your rough patch).³ If partners feel that a break-up is inevitable, then they will do things to end the relationship. Withdrawal or avoidance strategies are approaches that can be used to end a relationship,⁴ particularly when problems that are specific to the relationship are the reason for the breakup. By exploring another relationship, even with just a kiss with someone else, it is possible that your behavior was just a strategy to avoid the problems that the two of you were having with each other. In other words, pre-existing issues in your relationship may have been the problem, and your kissing someone else could have been used by your ex as an excuse to end your relationship that you both on some level believed was going to end anyway. This possibility may be difficult to accept, but if you do decide to reunite with each other, it would be important to explore with him all the other relationship issues that were going on between the two of you before the kissing incident. If you both love each other, such a transgression can be worked through with a lot of honest and sensitive communication. Otherwise, it is just best to grieve, move on, and focus on being a strong, healthy person so that your next relationship can be even healthier.

FDA approves drug to treat some obese, overweight adults | Health ...

Some people who suffer from chronic weight issues may soon get some help from a pill.? The U.S. Food and Drug Administration Wednesday approved Belviq, or lorcaserin hydrochloride, to be combined with a reduced-calorie diet and exercise, for treatment of chronic weight problems. Specifically, the FDA says,?it is approved for overweight or obese adults who have one or more medical conditions due to their weight, such as high blood pressure, type 2 diabetes or high cholesterol. The FDA says the drug works by activating a receptor in the brain that helps a person to eat less and still feel full. In trials, 47% of patients without type 2 diabetes lost at least?5% of their body weight.?By comparison,?23% of patients?treated with placebo lost at least 5% of their weight. In people with?type 2 diabetes, 38% of patients on Belviq lost at least?5% of their body weight compared to 16% on placebo, according to the FDA. "The results overall are quite modest," said Dr. Melina Jampolis , a physician nutrition specialist and CNN's diet and fitness expert. "But most experts agree that even a 5% weight loss has significant implications in terms of reducing the risk of obesity associated diseases including heart disease and diabetes." The FDA says the manufacturer of Belviq, Arena Pharmaceuticals, will be required to conduct six postmarketing?studies, including a long term cardiovascular trial to assess the risk of heart attack and stroke. "CSI," CBS Status: Renewed Why: Whenever the time comes, the "CSI" mothership will end with a lot of fanfare, but not this year. With new faces Ted Danson and Elisabeth Shue around, there is going to be at least one more season.

"CSI: Miami"

"CSI: Miami," CBS Status: Canceled Why: Out of the three (!) "CSI" programs on the air, "CSI: Miami" is the one to say goodbye first. The one-time ratings giant has been affected by football overruns (just as "The Good Wife" has) and "CSI: NY" has the edge in terms of total viewers, meaning a "Miami" sunset was inevitable.

"CSI: NY," CBS Status: Renewed Why: Of the two "CSI" spinoffs, "CSI: NY" is the stronger -- pulling in more than 10 million viewers on a Friday night is no easy task -- and with "CSI: Miami" canceled, "CSI: NY's" renewal was a no-brainer.

"The Good Wife," CBS Status: Renewed Why: This critical darling suffered after its move from Tuesdays to Sundays thanks to sports overruns. The viewers are frustrated, but given its strong cast and Emmy love, the show is still coming back for more.

"Hawaii Five-0," CBS Status: Renewed Why: Despite the scheduling setback as Alex O'Loughlin seeks treatment, Season 2 is still doing well for CBS in a very competitive timeslot.

"How To Be a Gentleman"

"How To Be A Gentleman," CBS Status: Canceled Why: Not even having "The Big Bang Theory" as a lead-in could save this David Hornsby project, which only lasted three episodes.

"How I Met Your Mother"

"How I Met Your Mother," CBS Status: Renewed Why: CBS renewed "How I Met Your Mother" for two more seasons in March 2011, so fans can look forward to being strung along about the titular mother's identity for a bit longer.

"The Mentalist"

"The Mentalist," CBS Status: Renewed Why: Although the show hit a season ratings low in the middle of February, its fanbase and overall ratings were enough to have it return for another season.
