LONDON (Reuters) - He was once a respected pediatrician, loved by patients and their parents for over 30 years. Now Domenico Mattiello faces trial for pedophilia, accused of making sexual advances towards little girls in his care.
Scientific experts will argue in court that his damaged brain made him do it, and his lawyers will ask for leniency.
It's the latest example of how neuroscience - the science of the brain and how it works - is taking the stand and beginning to challenge society's notions of crime and punishment.
The issue has been thrown into the spotlight by new technologies, like structural and functional magnetic resonance imaging (MRI), positron emission tomography (PET) scans and DNA analysis, that can help pinpoint the biological basis of mental disorders.
A series of recent studies has established that psychopathic rapists and murderers have distinct brain structures that show up when their heads are scanned using MRI.
And in the United States, two companies, one called No Lie MRI and another called Cephos Corp, are advertising lie-detection services using fMRI to lawyers and prosecutors.
CRIME AND PUNISHMENT
While structural MRI scans show the structure of a brain and can highlight differences between one brain and another, PET and fMRI scans can also show the brain in action, lighting up at particular points when the brain engages in certain tasks.
But the dazzling new technologies and detailed genetic data leave unanswered the issue of whether criminal courts are the right place to use this new information.
"The worry is that the law, or at least some judges, might be so overawed by the technology that they start essentially delegating the decision about guilt to a particular form of test," says Colin Blakemore, a professor of neuroscience at Oxford University.
The lawyers for American serial killer Brian Dugan, who was facing execution in Illinois after pleading guilty to raping and killing a 10-year-old girl, used scans of his brain activity to argue he had mental malfunctions and should be spared the death penalty. "ACQUIRED PAEDOPHILIA"
In Mattiello's case, the neuroscientific evidence will come in the form of a full psychiatric and biological analysis including an MRI brain scan that shows a roughly 4 centimeter tumor growing at the base of his brain.
This created pressure inside his skull and "altered his behavior", says Pietro Pietrini, a molecular geneticist and psychiatrist at Italy's University of Pisa who is compiling an expert report on the 65-year-old.
"His previous behavior was completely normal," Pietrini told Reuters. "He was a pediatrician for 30 something years and he saw tens of thousands of children and never had any problem. The question is why, at some point, did someone who has always behaved properly suddenly change so drastically?"
The doctor was arrested in Vicenza, northern Italy, more than a year ago and is undergoing cancer treatment after having the tumor removed. Pietrini is due to see him again next month to continue his assessment and see the effects of the treatment.
The case, which has yet go to court, is strikingly similar to another of "acquired pedophilia" dating back to 2002, in which a 40-year-old married American schoolteacher suddenly became obsessed with sex and began secretly to collect child pornography.
He was eventually removed from the family home for making sexual advances towards his step-daughter and convicted of pedophilia. But later medical examinations found he had an egg-sized tumor in a part of the brain involved in decision-making.
When the tumor was removed, the man recovered from his pedophilic tendencies and was able to return to his family.
Experts are generally agreed that conditions like psychopathy and pedophilia can't be "cured", but in this groundbreaking case it appeared that removing the tumor, and hence the pressure in the brain, may have re-established his ability to control impulses.
As in that case, Pietrini said he and colleague Giuseppe Sartori of Padua University believed Mattiello's tumor "may well have played a role in altering his behavior".
"This is what we will be arguing," Pietrini said. "But of course it will be for the judge to determine to what extent he believes this medical condition played a role."
Oxford's Blakemore, one of the world's leading thinkers in this field, says such cases are "startling".
"It makes one wonder about the notion of responsibility," he said in an interview.
IS "MY BRAIN MADE ME DO IT" A DEFENCE?
And when it comes to prison, should pedophiles, psychopaths and other violent criminals be punished less severely if their behavior can be blamed on biology? Is "my brain made me do it" a defense that warrants recognition with lighter sentences, or even no jail time at all?
"(It) raises the whole issue of what you think sentencing is for," says Blakemore. "Is it about punishment? Is it about retribution? Is it about remediation and rehabilitation? Is it about protecting society? Well, to some extent it's about all of those things."
Recent evidence - from both real and hypothetical cases - suggests judges are sympathetic to neurobiological evidence as mitigation.
A study published in the journal Science this month showed that criminal psychopaths in the United States whose lawyers provide biological evidence for their brain condition are more likely to be sentenced to shorter jail terms than those who are simply said to be psychopaths.
For the study, researchers at the University of Utah tweaked the real-life case of Stephen Mobley, a 39-year-old American who was sentenced to death in 1994 after robbing a Domino's pizza place in Georgia and shooting dead the restaurant's manager.
At his trial, Mobley's lawyer presented evidence in mitigation showing the accused had a variant of a gene called MAO-A that has been dubbed the "warrior" gene after scientists found it was linked to violent behavior.
AGGRESSIVE GENES
In the Science study, judges were given a hypothetical case loosely based on Mobley's, where the crime was a savage beating with a gun, rather than a fatal shooting.
All the judges were told the defendant was a psychopath, but only half were given expert testimony on the genetic and neurobiological causes of his psychopathy. Those who got the neuroscientific evidence were more likely to give a shorter sentence - generally about a year less, the study found.
Pietrini worked on a similar real-life case in Italy in 2009 - thought to be one of the first criminal cases in Europe to use this type of neuroscientific evidence.
It involved Abdelmalek Bayout, an Algerian living in Italy, who was tried and convicted for fatally stabbing a man who teased him in the street.
After conducting a series of tests on the Algerian, Pietrini and colleagues said they had found abnormalities in imaging scans of his brain, and in five genes that have been linked to violent behavior ? including MAO-A.
A 2002 study led by researchers at the Institute of Psychiatry at King's College London linked low levels of MAO-A with aggressiveness and criminal behavior in boys who were raised in abusive environments.
Bayout's lawyers got his sentence reduced by arguing that this and other bad genes had affected his brain and were partly to blame for the attack.
WHERE WILL IT END?
Experts say it's almost inevitable that neuroscience and law will become yet more intertwined. After all, while neuroscience seeks to find out how the brain functions and affects behavior, the law's main concern is with regulating behavior.
Yet many are uneasy about the use in courts of law - and in matters of life and death - of basic science that is only just creeping out of the lab.
Observers such as Hank Greely, a professor of law at Stanford University, point out that no scientific peer-reviewed studies have been published demonstrating that BEOS - the brain test used in the Mumbai case - actually works.
Others stress that while genes like MAO-A have been associated with violence, there are also plenty of people with similar genotypes who don't go out and kill, rape or abuse.
"Neuroscience is being used by serious scientists in real labs, but the people trying to apply it in courts are not those same people," says Utah's Brown. "So they're taking something that looks very objective, that looks like gold standard science, but then morphing it into a forensic use it wasn't developed for.
"This isn't snake-oil science. It's real science. But it's being misapplied."
Seena Fazel, a clinical senior lecturer in forensic psychiatry at Oxford University, says he's uncomfortable with the long-term implications and wonders where it will end.
There are already known biological bases for many brain disorders criminals suffer from, including drug addiction, alcoholism and antisocial personality disorder, which is thought to affect up to half of all those in prison.
"If psychopathy reduces your sentence because it has a biological basis, why shouldn't these other more common conditions also result in reduced sentences? The problem here is where do we draw the line?"

Can the world's existing farmlands provide enough crops to satisfy the hunger of the nine billion people?up from seven billion currently?that demographers predict will be living on the planet by the mid-21st century? A new study, published in Nature on August 30, suggests that increasing deforestation could be avoided provided farmers made better use of water and nutrients on land currently under cultivation around the globe. The central premise of the new analysis is that intensifying agriculture where it already exists is the key to preserving a balance between farming and forests. To do that, the researchers from McGill University in Montreal and the University of Minnesota (U.M.) analyzed the so-called yield gap. That's the difference between what the highest yielding farm or area within a given region can produce?for example, corn?compared with what the average yield is. The difference between this best-practice farm and the average farm is the yield gap.
The researchers then employed national and regional agricultural data from outfits such as the Food and Agriculture Organization of the United Nations and the International Fertilizer Industry Association to determine the root causes of these yield gaps. Simply by improving fertilizer application and irrigation, the researchers find that global yields of corn, wheat and rice?the three main staple crops?could be increased by 64 percent, 71 percent and 47 percent, respectively.
"We are not claiming to diagnose the exact management practices needed on any particular plot of land," explains research fellow Nathan Mueller, who led the study from the U.M.'s Institute on the Environment, because local factors such as soils and weather can play an important role. Instead, the goal is to identify what practices might help close yield gaps at the regional or even global level and highlight those areas most in need of intervention.
That list includes the U.S. Great Plains and China, where more fertilizer is used than is strictly necessary. For example, American farmers apply so much fertilizer on Midwestern corn fields that much of it ends up running off, ending up in the Mississippi River and, ultimately, reaching the Gulf of Mexico. There the copious fertilizer fuels a bloom of algae and other microscopic plants that then die. Microbes that consume the dead plants also use all the oxygen available in surrounding waters, creating a vast "dead zone" that is devoid of sea life?an unfortunate side effect of the demand for more maize.
Lessening fertilizer use in the U.S. and China would free up nutrients to be applied to fields in eastern Europe and western Africa with no detriment to American or Chinese people. As it stands, the researchers estimate that some 11 million metric tons of nitrogen fertilizer and five million metric tons of phosphate could be saved annually at present without diminishing current yields. Those savings then could be applied to underachieving areas.
LAGOS, Nigeria (AP) ? Personnel records of former and current members of Nigeria's top domestic spy agency, including home addresses and names of immediate family members, leaked onto the Internet in a threatening message that claimed to come from a radical Islamist sect that's killed hundreds of people this year alone, The Associated Press has learned.
The leak of personal data of more than 60 past and current employees of Nigeria's State Security Service remained easily accessible on the Internet for days and had details about the agency's director-general, including his mobile phone number, bank account particulars and contact information for his son.
Many of agents listed who could be reached by the AP said they received no official warning from the spy agency that their information had been posted online nor been otherwise alerted. The material has been deleted from the comment section of a website, but the security breach astonished spy service veterans and calls into question whether Nigeria's intelligence community, whose agents already have released suspected terrorists out of religious and ethnic sympathies, are too compromised from within to stop the violence now plaguing Africa's most populous nation.
A senior Nigerian intelligence official said authorities were aware that the leak had happened and that many were embarrassed by it. He spoke on condition of anonymity as information about the leak was not to have been made public.
Marilyn Ogar, a spokeswoman for the State Security Service, declined to answer questions Thursday about the posting of the information.
The State Security Service, created in 1986 by then-military ruler Gen. Ibrahim Babangida, monitors domestic dissent in Nigeria, an oil-rich nation of more than 160 million people. Though geared toward stopping terrorism and destabilizing coups, the agency routinely faces criticism for targeting government critics. In Abuja, Nigeria's capital, the agency operates out of cars made to look like the many green taxis that roam the streets. Plain-clothed agents of the service routinely question foreign journalists at airports, border crossings and on city streets if they see reporters conducting interviews. Agents carrying assault rifles often guard major events in the country.
Many agents for the typically secretive agency are preoccupied with concealing their identities, as most try to blend unnoticed into society.
The information leak came in two postings earlier this month on a website that provides rewritten news on Nigeria. The first posting threatened to kill agents of the State Security Service on behalf of Boko Haram, a radical Islamist sect responsible for more than 660 killings this year alone in Nigeria. The second posting simply offered a block of text containing biographical and other details about the agents.
Though the comments have been removed, the AP is not identifying the website involved as cached versions of the comments remain online and intelligence service agents have been killed by Boko Haram members in the past.
The list includes former and current agents across the country, including Director-General Ekpeyong Ita. Those reached by the AP who were willing to talk expressed disbelief that sensitive information like that could make its way to the Internet.
"I was shocked to see my details posted on the Internet," said one former agent, who declined to be named out of safety concerns. "I've not heard anything from anybody. I was surprised that such information could be leaked."
Another man on the list said he simply once served as a doctor to help the agency on an on-call basis only. The list appeared to include lower-ranking agents, as well as one-time state directors for the agency.
Some of those contacted suggested that the list appeared to come from the agency's pension department, as it mostly included retirees and listed bank account information for nearly all those named. It was not immediately clear if the information had been hacked from the outside and obtained or taken out by an agency employee or someone with access to the material.
The release of the information comes as Nigeria's intelligence agencies have made a series of blunders in trying to fight Boko Haram in Africa's most populous country, with some likely influenced by ethnic or religious sentiments. Intelligence agencies allegedly released a suspected Islamic radical in 2007 who later masterminded Boko Haram's suicide car bombing of the U.N. headquarters in August 2011 that killed at least 25 people and wounded more than 100 others, officials previously told the AP. A leaked U.S. diplomatic cable also show U.S. officials complained in 2008 about Nigeria's government quietly releasing other suspects into the custody of Islamic leaders as part of a program it called "Perception Management."
Another U.S. diplomatic cable complains that State Security Service agents nearly let a suspected bomb maker trained by the Somali terror group al-Shabab onto an international flight, despite an Interpol notice for his arrest. The agents who allegedly tried to release Mohamed Ibrahim Ahmed "not only knew about the Interpol notice, but simply said they did not want to hold him any longer," the February 2010 cable read.
Ahmed, an Eritrean, pleaded guilty to charges in June in a U.S. federal court that he supported terrorism by associating with al-Shabab, a terror group with links to al-Qaida. He faces up to 10 years in prison.
Most of those on the leaked list of agents reached by the AP said no one from the federal government or the spy agency warned them that their personnel information had appeared on the Internet. Instead, colleagues and other former agents called each other to spread the news and later contacted the State Security Service themselves to report the breach.
It is unclear if the person who posted the information online really does have ties to Boko Haram, which has targeted security officials in the past. Violence has been centered mostly in the country's Muslim north. One retired agent who spoke to AP said he was grateful he lives in the largely Christian south, away from the sect's attacks.
"It's worrying that they have access to that," the agent said. "Those living in Abuja (and the north) are the ones who should living in fear."

An attorney for Lisa Kudrow said he and the actress are considering taking a legal dispute with her former manager to the California Supreme Court.
The legal dispute began in 2008, when Kudrow's former manager, Scott Howard, sued her for refusing to pay him more than $50,000 in fees from her earnings from the television show Friends and other projects.
Last week, an appeals court ruled as admissible "expert" testimony that it is customary practice to pay managers a cut from projects received after a working relationship ends. Kudrow's lawyer has sought to keep that testimony out of the trial, which has not yet gone to a jury.
"The bottom line at this point in time is we are taking a look at possibly petitioning the California Supreme Court to look at the matter and at the same Ms. Kudrow is looking forward to having the matter decided in front of a jury if the matter proceeds to a trial court for a determination," said her attorney, Gerald Sauer of the law firm Sauer & Wagner LLP.
In 1991, Howard said the two had made an oral agreement that would receive a 10-percent cut of Kudrow's income, according to the lawsuit.
Starting in 1992, Kudrow had made recurring guest appearances on NBC's Mad About You. From 1994 through 2004, she starred as Phoebe in the hit series Friends. Howard and his company, Howard Entertainment Inc., did not return a request for comment.
In 2000 and 2004, the two modified their oral agreement to lower Howard's commission on certain earnings from Friends, eventually down to five percent, according to decision from the California court of appeal.
The recent declaration in question was submitted by Hollywood manager Martin Bauer on behalf of Howard.
Bauer said that "from at least the early 1980s, it had been the custom and practice in the entertainment industry for a personal manager to be paid post-termination commissions on the services that their clients rendered, and on engagements that their clients entered into, when the personal manager was representing them," according to the court filing.
A Los Angeles County Superior Court barred Howard from admitting the Bauer's testimony, and he granted Kudrow summary judgment. The appeals court reversed Wednesday, saying Bauer should be allowed to testify on remand, as reported by Courthouse News Service.
Kudrow's attorney said the court of appeals "obviously has taken a different view" than the lower courts.
"The court of appeals opinion by no means indicates there is an industry practice custom that would apply to this case," Sauer said. "We will be given an opportunity at trial that an industry custom did not exist when Kudrow and Howard entered into the original relationship in 1991."
Sauer, who said Kudrow would decline to comment, said they have until Oct. 1 to decide if they will file a petition with the California Superior Court.
When asked for his reaction to the now four-year-old case, Sauer said, "The legal process is one with twists and turns. You never know how long it is going to take."

A new study reveals that the brain clock itself is driven, in part, by metabolism, the production and flow of chemical energy in cells. The researchers focused primarily on a phenomenon known as "redox" in tissues of the SCN from the brains of rats and mice.
Redox represents the energy changes of cellular metabolism (usually through the transfer of electrons). When a molecule gains one or more electrons, scientists call it a reduction; when it loses electrons, they say it is oxidized. These redox reactions, the researchers found, oscillate on a 24-hour cycle in the brain clock, and literally open and close channels of communication in brain cells.
They report their findings in the journal Science, which also wrote a Perspective on the research. "The language of the brain is electrical; it determines what kind of signals one part of the brain sends to the other cells in its tissue, as well as the other parts of the brain nearby," said University of Illinois cell and developmental biology professor Martha Gillette, who led the study. "The fundamental discovery here is that there is an intrinsic oscillation in metabolism in the clock region of the brain that takes place without external intervention. And this change in metabolism determines the excitable state of that part of the brain."
The new findings alter basic assumptions about how the brain works, Gillette said.
"Basically, the idea has always been that metabolism is serving brain function. What we're showing is metabolism is part of brain function," she said. "Our study implies that changes in cellular metabolic state could be a cause, rather than a result, of neuronal activity."
The study team also included graduate student Yanxun Yu, postdoctoral researcher Gubbi Govindaiah, graduate student Xiaoying Ye, graduate student Liana Artinian, electrical and computer engineering professor Todd Coleman, chemistry professor Jonathan Sweedler and pharmacology professor Charles Cox. Gillette, Govindaiah, Ye, Sweedler and Cox also are affiliates of the Beckman Institute at Illinois.

Romney commented in an interview Monday with CBS News.
Romney's position on abortion rights has evolved. When he ran for the U.S. Senate in Massachusetts, he backed abortion rights. As a presidential candidate, he has opposed abortion rights and says the Supreme Court should reverse the landmark Roe v. Wade decision that legalized abortion.
In a statement, Romney campaign spokeswoman Andrea Saul said Romney's position is clear ? that he opposes abortion except for cases of rape, incest and where the life of the mother is threatened.
"Well, I thought his comments were a little bit outrageous," she <a href="http://www.kjzz.org/content/1208/gov-brewer-akin-comments-little-bit-outrageous-doesnt-call-candidate-drop-out-race" target="_hplink">told KJZZ's Mark Brodie</a>. "I'm not in a position to [decide] whether it's right for the party to pull funding, I mean, those people there raise the money, they get to spend it however they wish."

1. Simply Satisfying Salmon
Back to School Recipes: 4 5 oz. Wild salmon filets ? cup Mustard ? cup Breadcrumbs 4 Ears of fresh corn Haricot verts (either frozen or fresh) Serves: 4 1. Set oven at 350 degrees.
2. Place salmon on a foil lined baking sheet & spread about ? tbspn mustard on each filet. Then cover w/ a layer of bread crumbs. 3. Cover w/ a foil tent and bake for ten minutes. 4. Microwave the ears of corn for 5 minutes per 2 ears w/ the husks on. 5. Steam the haricot verts in a steamer for about 8 minutes.
6. After ten minutes, remove foil tent & broil for 5 minutes or until salmon is ready (flaky and pink not red).
7. Serve each salmon filet w/one ear of corn & haricot verts.
Quick Fix:
Can use frozen green beans. Make sure each salmon filet is of equal thickness.

Back to School Recipes: 1 cup chopped almonds, peanuts, and/or sunflower seeds 2 cups raisins, dried cranberries and/or dried blueberries 1.5 cups oats 2 cups any high fiber cereal (if larger pieces, break them up) ? cup ground flaxseed ? cup all natural peanut butter, almond butter or sunflower seed butter 1/3 cup packed brown sugar ? cup honey 1 teaspoon vanilla
1. Combine first 5 ingredients & mix. Set aside.
2. Combine nut/seed butter, brown sugar and honey. Microwave for 1 minute or until bubbling. Remove and stir in vanilla.
3. Pour hot mixture over dry ingredients and toss.
4. Press mixture firmly into a lightly greased 9 x 13 pan. If mix is sticking to your hands, place wax paper over mixture while pressing down firmly.
5. Refrigerate for 30 minutes
6. Cut into 25-30 bars.

Mango Lassi:
*1/2 cup Coffee-mate Natural Bliss Low-fat Vanilla
*1 cup canned mango pulp or 2 ripe mangoes, seeded, peeled and cut into small chunks
*1 cup plain yogurt or plain fat-free Greek yogurt
*Pinch of salt (optional)
*1/8 teaspoon ground cardamom (optional)
-Place Coffee-mate, mango and yogurt in blender; cover. Blend for 2 minutes.
-Add salt and cardamom to taste and blend for about 1 minute or until creamy and smooth.
-Pour into 4 small serving glasses and chill in the refrigerator for about 1 hour or until cold. Enjoy!

Blend together butter and sugar in a
bowl until light and fluffy. Beat in
egg, orange juice and zest; set aside.
Combine flour and baking powder in
a small bowl; stir into butter mixture
until blended. Stir in cereal. Drop
by tablespoonfuls, 2 inches apart,
on an ungreased baking sheet. Bake
at 350 degrees for 10 to 12 minutes,
until golden around edges. Cool on
a wire rack. Makes 1-1/2 dozen.

Directions
1. Cook beef and next 3 ingredients in a large skillet, stirring until beef crumbles and is no longer pink. Add seasoning, salt & pepper; drain and remove from heat.
2. Divide dough evenly into 4 pieces; pat each dough piece into one square. Spoon beef mixture leaving a 1/2-inch border; top with cheese.
3. Fold dough over filling until edges almost meet; crimp edges of dough.
4. Bake at 450F for 10 to 12 minutes.

Kale pesto - 2 cups chopped + blanched kale, 1 clove garlic, 1/2 cup olive oil, juice of 1/2 lemon, season to taste. Try it with other green veg too.
